product availability
certain products may be available exclusively online and in limited quantities, including limited drops and collaboration releases. we reserve the right to limit quantities, discontinue products, or refuse sales to any person or region at our discretion. once a limited drop sells out, we are under no obligation to restock it. products released as part of limited drops or third party collaborations may be subject to additional terms specific to that release, which will be posted on the relevant product page.
shipping and delivery
we will use reasonable efforts to ship and deliver products within the timeframes stated on our site, but delivery dates are estimates only and time is not of the essence. we are not liable for delays in delivery caused by carriers, customs, weather, or other circumstances outside our reasonable control. we are not responsible for packages confirmed as delivered by the carrier that are later lost or stolen; if this happens, please contact your payment provider and our customer support team. we may deliver a single order in multiple shipments and reserve the right to split shipments at our discretion. if international shipping is offered, you may be responsible for duties, taxes, and import fees charged by your country's customs authority; these charges are generally non refundable if you return an international order, and any reimbursement must be pursued directly with the relevant customs authority.
accuracy of billing and account information
we reserve the right to refuse or cancel any order, and to limit quantities purchased per person, household, or order. you agree to provide current, complete, and accurate purchase and account information, and to update it promptly as needed.
order acceptance
receipt of an order confirmation email does not constitute our acceptance of your order, nor a confirmation of our offer to sell. your order does not become binding on Nostalgia until you receive a shipping confirmation, or until the product is actually shipped, whichever occurs first. prior to sending a shipping confirmation, we reserve the right to reject or cancel an order for any reason, including limited or unavailable stock, suspected fraud, or pricing/listing errors.
no purchase for resale
our site is intended for retail customers purchasing for personal use. by placing an order, you represent that you are not a wholesaler, reseller, distributor, or acting as an agent for one, and that you are not purchasing for the purpose of resale. we reserve the right to refuse, limit, or cancel any order we believe, in our sole discretion, is intended for resale, including orders that exceed reasonable personal use quantities, use duplicate or suspicious account/payment/shipping details, or are placed using automated means such as bots to bypass purchase limits on limited drops or collaboration releases.
order cancellations
once an order is submitted and payment is confirmed, you may not be able to cancel or modify it, particularly for limited drops or made to order items. contact us as soon as possible at support@enternostalgia.com if you need to request a change, and we will accommodate this where reasonably possible prior to shipment.
final sale items
any item marked or sold as "sale" at checkout or on the product page is final sale and is not eligible for cancellation, modification, return, or refund, except where required by law.
promotional offers and discount codes
we reserve the right to cancel any transaction or refuse any discount we determine, in our sole discretion, to involve unauthorized, altered, fraudulent, or ineligible use of a promo code, and to modify or end any promotion at any time, including due to a system or pricing error. discounts do not apply to gift cards, shipping and handling, or taxes unless explicitly stated. discount codes may not be combined with other offers unless the offer's terms specifically say otherwise.

we may provide access to third party tools that we do not control. such tools are provided "as is" without warranties of any kind. your use of optional third party tools is at your own risk.

license to use site

indemnification

dispute resolution and arbitration
agreement to arbitrate
you and Nostalgia agree that any dispute, claim, or controversy arising out of or relating to these terms or your use of the service will be resolved through binding arbitration, rather than in court, except as set forth below.
right to opt out
you may opt out of this arbitration agreement by sending written notice to support@enternostalgia.com within 30 days of first accepting these terms, stating your name, order/account information, and a clear statement that you wish to opt out of arbitration. if you opt out, disputes will be resolved in the state or federal courts located in san francisco county, california, and you and Nostalgia each waive any objection to venue or jurisdiction there.
arbitration procedure
if you do not opt out, arbitration will be conducted by a single arbitrator under the rules of the american arbitration association (aaa), and judgment on the arbitration award may be entered in any court having jurisdiction. arbitration will take place in california, or, at your option, via phone or video conference.
class action waiver
you and Nostalgia agree that any arbitration or court proceeding will be conducted only on an individual basis and not as part of a class, consolidated, or representative action. if this class action waiver is found unenforceable, the remainder of this arbitration section will remain in effect.
small claims exception
either party may bring an individual claim in small claims court instead of arbitration, if the claim qualifies.
severability
if any provision of these terms is found unlawful or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full effect.
termination
these terms remain effective until terminated by you or us. we may terminate this agreement and deny you access to the service at any time, without notice, if we believe you have violated any term of these terms. you remain liable for all amounts due as of the termination date.
entire agreement
these terms, together with any policies posted on this site, constitute the entire agreement between you and Nostalgia regarding the service, superseding any prior agreements or communications.
governing law
these terms are governed by the laws of the state of california, without regard to its conflict of law provisions, except where superseded by the arbitration terms above.
